Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected. Without limiting the foregoing, neither the Company nor any of the company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components. Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Mosquito Control: Service Agreement

This agreement covers mosquito control work arranged through Dave’s Mosquito & Tick Services and applies together with the general Terms and Conditions posted on this website. Booking a treatment or a program means you accept both. It is written to set clear expectations around access, products, and results before a technician treats your yard.

Scheduling and Recurring Visits

Dave’s Mosquito & Tick Services makes reasonable efforts to treat at the time agreed at booking. Recurring programs are scheduled on a regular interval while mosquitoes are active in your area. Availability, weather, road conditions, and the length of earlier visits can move a scheduled time, and we let you know as soon as we can when it shifts. Special-event and last-minute requests are taken where possible, though specific timing cannot be promised.

Getting the Yard Ready

On the service date, the yard and any areas to be treated need to be accessible. Please keep pets and children indoors and off treated areas until the application has dried, unlock gates and approach routes so the technician can reach the spots to be treated, and secure any animals. Areas blocked by stored items, heavy clutter, or locked enclosures can add time and may add cost, as set out further down.

Weather and When We Hold Off

Dave’s Mosquito & Tick Services may decline or postpone treatment when conditions are unsafe or unsuitable. That includes active rain or high wind affecting spray application, flooding, hazardous materials in the work area, aggressive or unsecured animals, or no safe way to reach the areas to be treated. Rescheduling forced by weather or these conditions may carry a trip charge or rescheduling fee.

Products, Pollinators, and Re-Entry

Products applied by Dave’s Mosquito & Tick Services are used according to their label directions and the applicable local, state, and federal regulations. Please keep people and pets off treated foliage and surfaces until the application has dried, following the technician's guidance. Tell us up front about known allergies or chemical sensitivities, beehives, ornamental ponds with fish, pollinator gardens, or sensitive individuals or pets, so reasonable precautions can be taken and sensitive areas can be avoided. Dave’s Mosquito & Tick Services is not responsible for reactions arising from undisclosed sensitivities or from a failure to follow re-entry guidance.

What Mosquito Service Covers

A standard visit covers inspection for standing-water breeding sources, source-reduction recommendations, larviciding of standing water where appropriate, and barrier or perimeter spray treatment of foliage, shrubs, and shaded resting areas, so long as the targeted areas can be reached during the visit. An optional tick and flea add-on may be included where requested. When the work is finished, you receive a service ticket recording the date, the areas treated, and any follow-up or source-reduction the technician recommends.

Mosquitoes First: What Falls Outside

This is a mosquito service. It does not include general pest control for other pests such as termites, bed bugs, cockroaches, ants, rodents, or wasps, and it does not include structural repair or wildlife work. Those services are outside the scope of mosquito control and would be arranged separately.

Yard Access and Sensitive Features

Treating a yard can mean working across lawns, garden beds, landscaped areas, fence lines, and shaded resting sites. Dave’s Mosquito & Tick Services takes reasonable care to keep disturbance to a minimum, but you acknowledge that incidental contact with treated surfaces can be a normal part of the visit. Dave’s Mosquito & Tick Services is not responsible for incidental impact to lawns, landscaping, sprinkler systems, invisible fencing, or other buried or unmarked features. If you want to flag such features, or point out ornamental ponds and pollinator gardens to avoid, please do so before the service date.

Re-Service and Why Results Vary

Customers on a recurring program may request a no-charge re-service between scheduled visits in line with the terms of their plan, and Dave’s Mosquito & Tick Services will make reasonable efforts to accommodate those requests promptly. Results vary with standing water on or near the property, dense vegetation, weather, untreated neighboring yards, and wooded or wetland edges. You acknowledge that consistent results depend in part on reducing standing water and following the technician's recommendations.

Added Charges

A few situations add to a standard visit. The most common are:

  • Larger properties, acreage, or extensive landscaping that needs additional product or time
  • Hard-to-reach areas or heavily cluttered yards
  • Trip charges for sites that are inaccessible, unsafe, or otherwise not serviceable
  • Short-notice rescheduling
  • One-time special-event sprays and last-minute requests
  • Misting system installation, refills, or shutdown service

Wherever practical, added charges are explained before the extra work proceeds and billed on the terms Dave’s Mosquito & Tick Services provides.

Payment

Unless agreed otherwise in writing, payment is due on completion of the visit, or on the billing schedule of a recurring program, using the methods given at booking. If you question a charge, raise it with Dave’s Mosquito & Tick Services within a reasonable time so it can be checked against the service ticket and the technician's notes.

Agreement and Outside Providers

By booking mosquito control with Dave’s Mosquito & Tick Services, you confirm you have read, understood, and accepted these terms together with the general Terms and Conditions on this website. When demand, scheduling, or availability calls for it, Dave’s Mosquito & Tick Services may arrange an independent third-party mosquito control provider to carry out the work. That provider is independent and is not an employee or agent of Dave’s Mosquito & Tick Services, and you are responsible for confirming the provider holds the licenses, insurance, and permits the job requires in your area. Not following these terms can lead to service being declined, rescheduled, or charged differently.

This site is a free service to assist homeowners in connecting with local service contractors. All contractors are independent and this site does not warrant or guarantee any work performed. It is the responsibility of the homeowner to verify that the hired contractor furnishes the necessary license and insurance required for the work being performed. All persons depicted in a photo or video are actors or models and not contractors listed on this site.
